The man arrested yesterday in the hit-and-run death of a bicyclist riding to work last month was charged with DUI a year ago.

The Pima County Sheriff’s Department arrested Enrique F. Hernandez, 24, on second degree murder and leaving the seen of a crash in the death of Sun Tran driver John Akers, yesterday.

Akers was riding his bike to work when he was allegedly struck and killed by Hernandez near the intersection of Irvington and Mission Roads last month.

According to court records, Hernandez has had two other traffic issues including a DUI in May of 2012.

According to the record, it was Hernandez’ first DUI and his blood-alcohol level was above .08. He was also ticketed for not having a valid driver license  at the time of the stop.

Pima County Deputies allege alcohol was involved in the crash that killed Akers.

In 2009 Hernandez was stopped and ticketed for not having a valid driver license and not having mandatory insurance.

According to the court record from yesterday’s arrest, Hernandez is being held on $500,000 bail.

  1. And another decent human being killed by yet another irresponsible piece of human refuse and by the revolving-door judicial system that keeps letting them out to do the same thing over, and over, and over…
    Maybe that’s why so many people do not want to give up their cars, they know they really won’t be held accountable for their behavior behind the wheel.
    Yeah, I’m angry.

  2. Why does it always take someone’s death for these people who drink and drive to be taken off the road for good?  This, and ALL the related drunk-driving fatalities could have been prevented.  It is so sad…

  3. Cyclists, just like pedestrians,  rely on drivers doing the right thing.  When drivers don’t, the consequences are huge.  In the past, the city and county have slapped the writsts of drivers who hit bicyclists.  It’s encouraging to finally see things changing.

  4. I’m not sure I believe that local governments have historically “slapped the wrists” of drunken drivers who kill bicyclists, but in this case, a diagnosis of fetal alcohol syndrome might shave several months off the sentence.

  5. Excuse me? He was ticketed for driving with no license and no insurance in 2009? How can he still be allowed to roam free and endanger everybody??? Hispanic name, Hispanic looks, no drivers license, no ID, no insurance… helloooo!!!!! Brains, anyone??? How can authorities ticket someone like this instead of arresting him, deporting him and getting this scumbag off the roads? Congratulations! This cyclist died courtesy of flawed laws and misguided PCness. With a minimum of common sense, he could still be alive today. If this is how laws protect us, might as well get used to a cyclist getting killed each day. What is the death of a person compared to the personal freedom of another? Disgusting.
